โรคพาร์กินสัน (Parkinson’s Disease, PD) เป็นโรคความเสื่อมของระบบประสาท ซึ่งจะส่งผลให้สารโดปามีนในสมองลดลง สารนี้มีความสำคัญในการควบคุมการเคลื่อนไหวของกล้ามเนื้อ ส่งผลให้เกิดการเคลื่อนไหวที่ผิดปกติ แสดงออกเป็นลักษณะที่สำคัญของผู้ป่วยพาร์กินสันเช่น

  • อาการสั่น
  • อาการแข็งเกร็ง
  • อาการเคลื่อนไหวช้าหรือเคลื่อนไหวน้อย
  • การทรงตัวที่ไม่มั่นคง
  • ปัญหาการเดินติดขัด

เมื่อผู้ป่วยพาร์กินสันที่เป็นระยะเวลานาน ๆ อาจจะไม่ตอบสนองต่อการรักษาทางยาหรือมีปัญหาการตอบสนองต่อยาไม่สม่ำเสมอ เช่น อาการยาหมดฤทธิ์ก่อนกำหนด, อาการยุกยิก และอาการยาออกฤทธิ์ช้าหรือยาไม่ออกฤทธิ์ นอกจากนั้นเมื่อผู้ป่วยรับการรักษาด้วยยาเป็นระยะเวลานานยังส่งผลให้ได้รับผลข้างเคียงจากยา เช่น มีอาการคลื่นไส้อาเจียน, ยุกยิก, เห็นภาพหลอน, หูแว่ว ได้

การดูแลผู้ป่วยโรคพาร์กินสันให้มีประสิทธิภาพ จำเป็นต้องอาศัยความร่วมมือจากทั้งผู้ป่วยและญาติ ซึ่งบางครั้งการอธิบายว่ายาที่รับประทานอยู่ให้ผลการรักษาที่พึงพอใจมากน้อยเพียงใดอาจจะยากที่จะอธิบายด้วยวาจาเปล่าๆ –– การจดบันทึกผลการรักษารวมทั้งผลข้างเคียงจากการใช้ยาไว้ จะช่วยให้แพทย์สามารถดูแลการรักษาโรคให้ดีขึ้น สำหรับการดูแลผู้ป่วยพาร์กินสันในปัจจุบันมีเครื่องมือที่ใช้กัน คือบันทึกประจำวันของผู้ป่วย (Patient’s diary) เป็นเครื่องมือที่จะช่วยให้ผู้ป่วยสามารถจดบันทึกยาที่ต้องกินในแต่ละวัน ผลจากการใช้ยา รวมถึงอาการข้างเคียงต่างๆไว้ และช่วยให้แพทย์สามารถปรับขนาดยาในการรักษาให้เหมาะสมได้ดีขึ้น

แต่การใช้บันทึกประจำวันของผู้ป่วยยังมีข้อจำกัดอยู่มาก เช่น

  • ผู้ป่วยจำเป็นต้องการจดบันทึกตลอดเวลา อาจทำให้ไม่สามารถทำกิจวัตรประจำวันได้อย่างเต็มที่
  • จำเป็นต้องพกสมุดบันทึกติดตัว มีโอกาสที่สมุดจะมีการชำรุด หรือสูญหาย
  • ผู้ป่วยบางคนเบื่อหน่ายกับการจดบันทึก หยุดจดบันทึก ทำให้ได้รับข้อมูลไม่ครบถ้วน
  • การจดข้อมูลยาในสมุดอาจเกิดความผิดพลาดไม่ตรงกับที่แพทย์สั่ง
  • รวมถึงข้อจำกัดในส่วนของแพทย์ ที่จะประเมินจากสมุดบันทึกได้ลำบากหากมีปริมาณข้อมูลที่จดบันทึกไว้มาก รวมถึงอาจมีความลำบากในด้านการประเมินข้อมูลเพื่อช่วยในการตัดสินใจวางแผนการรักษาต่อเนื่อง

ในปัจจุบันโรคพาร์กินสันเป็นโรคที่ยังรักษาให้หายขาดไม่ได้ รวมถึงยังไม่มีวิธีที่จะสามารถวินิจฉัยโรคก่อนจะเกิดอาการแสดงขึ้นมา ในปัจจุบันมีงานวิจัยใหม่ๆจำนวนมากที่พยายามจะหาวิธีที่จะสามารถวินิจฉัยโรคพาร์กินสันให้เร็วยิ่งขึ้นก่อนที่จะมีอาการแสดงชัดเจน เพื่อจะหาว่ามียาหรือการรักษาอื่นใดที่จะสามารถปรับเปลี่ยนการดำเนินโรคได้บ้าง ซึ่งโรงพยาบาลจุฬาลงกรณ์เป็นโรงพยาบาลระดับตติยภูมิและโรงเรียนแพทย์ชั้นนำของประเทศมีพันธกิจเป็นผู้คิดค้น วิจัยและพัฒนานวัตกรรมทางด้านโรคพาร์กินสันและกลุ่มความเคลื่อนไหวผิดปกติ ในระดับประเทศและนานาชาติ หากมีเครื่องมือที่จะสามารถเก็บรวบรวมข้อมูลปริมาณมากที่เกิดขึ้นในรูปแบบต่างๆ รวมไปถึงช่วยในการจัดการวิเคราะห์ข้อมูลอย่างเป็นระบบและมีความน่าเชื่อถือจะนำไปสู่การสร้างงานวิจัยและนวัตกรรมใหม่ๆขึ้นมาได้อีกเป็นจำนวนมาก

PDPlus is licensed to You (End-User) by Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders, located at Sor Tor Building 7th Floor Chulalongkorn Hospital, 13 Rama IV Rd, Pathum Wan, Pathum Wan District, Bangkok 10330, Thailand (hereinafter: Licensor), for use only under the terms of this License Agreement.

By downloading the Application from the Apple AppStore, and any update thereto (as permitted by this License Agreement), You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement.

The parties of this License Agreement acknowledge that Apple is not a Party to this License Agreement and is not bound by any provisions or obligations with regard to the Application, such as warranty, liability, maintenance and support thereof. Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders, not Apple, is solely responsible for the licensed Application and the content thereof.

This License Agreement may not provide for usage rules for the Application that are in conflict with the latest App Store Terms of Service. Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders acknowledges that it had the opportunity to review said terms and this License Agreement is not conflicting with them.

All rights not expressly granted to You are reserved.

THE APPLICATION

PDPlus (hereinafter: Application) is a piece of software created to Facilitating comprehensive care for Parkinson's Disease patient in Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders - and customized for Apple mobile devices. It is used to Electronic substitute to the Patient Diary.

Furthermore, it is used to Recording daily disease's activities, Medications reminders, Physical examinations for self evaluations and View medication and compliance summary.

SCOPE OF LICENSE

  1. You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded Products that You (End-User) own or control and as permitted by the Usage Rules set forth in this section and the App Store Terms of Service, with the exception that such licensed Application may be accessed and used by other accounts associated with You (End-User, The Purchaser) via Family Sharing or volume purchasing.
  2. This license will also govern any updates of the Application provided by Licensor that replace, repair, and/or supplement the first Application, unless a separate license is provided for such update in which case the terms of that new license will govern.
  3. You may not share or make the Application available to third parties (unless to the degree allowed by the Apple Terms and Conditions, and with Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders's prior written consent), sell, rent, lend, lease or otherwise redistribute the Application.
  4. You may not reverse engineer, translate, disassemble, integrate, decompile, integrate, remove, modify, combine, create derivative works or updates of, adapt, or attempt to derive the source code of the Application, or any part thereof (except with Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders's prior written consent).
  5. You may not copy (excluding when expressly authorized by this license and the Usage Rules) or alter the Application or portions thereof. You may create and store copies only on devices that You own or control for backup keeping under the terms of this license, the App Store Terms of Service, and any other terms and conditions that apply to the device or software used. You may not remove any intellectual property notices. You acknowledge that no unauthorized third parties may gain access to these copies at any time.
  6. Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.
  7. Licensor reserves the right to modify the terms and conditions of licensing.
  8. Nothing in this license should be interpreted to restrict third-party terms. When using the Application, You must ensure that You comply with applicable third-party terms and conditions.

TECHNICAL REQUIREMENTS

  1. Licensor attempts to keep the Application updated so that it complies with modified/new versions of the firmware and new hardware. You are not granted rights to claim such an update.
  2. You acknowledge that it is Your responsibility to confirm and determine that the app end-user device on which You intend to use the Application satisfies the technical specifications mentioned above.
  3. Licensor reserves the right to modify the technical specifications as it sees appropriate at any time.

MAINTENANCE AND SUPPORT

  1. The Licensor is solely responsible for providing any maintenance and support services for this licensed Application. You can reach the Licensor at the email address listed in the App Store Overview for this licensed Application.
  2. Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders and the End-User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the licensed Application.

USE OF DATA

You acknowledge that Licensor will be able to access and adjust Your downloaded licensed Application content and Your personal information, and that Licensor's use of such material and information is subject to Your legal agreements with Licensor and Licensor's privacy policy: http://chulapd.org/en/article/16/#privacy_policy.

USER GENERATED CONTRIBUTIONS

The Application may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or in the Application, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Application and through third-party websites or applications. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

  1. The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
  2. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Application, and other users of the Application to use your Contributions in any manner contemplated by the Application and these Terms of Use.
  3. You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness or each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Application and these Terms of Use.
  4. Your Contributions are not false, inaccurate, or misleading.
  5. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
  6. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
  7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
  8. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
  9. Your Contributions do not violate any applicable law, regulation, or rule.
  10. Your Contributions do not violate the privacy or publicity rights of any third party.
  11. Your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
  12. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
  13. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
  14. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.

Any use of the Application in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Application.

CONTRIBUTION LICENSE

By posting your Contributions to any part of the Application or making Contributions accessible to the Application by linking your account from the Application to any of your social networking accounts, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use copy, reproduce, disclose, sell, resell, publish, broad cast, retitle, archive, store, cache, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial advertising, or otherwise, and to prepare derivative works of, or incorporate in other works, such as Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.

This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area in the Application. You are solely responsible for your Contributions to the Application and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations in the Application; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.

LIABILITY

  1. Licensor's responsibility in the case of violation of obligations and tort shall be limited to intent and gross negligence. Only in case of a breach of essential contractual duties (cardinal obligations), Licensor shall also be liable in case of slight negligence. In any case, liability shall be limited to the foreseeable, contractually typical damages. The limitation mentioned above does not apply to injuries to life, limb, or health.
  2. Licensor takes no accountability or responsibility for any damages caused due to a breach of duties according to Section 2 of this Agreement. To avoid data loss, You are required to make use of backup functions of the Application to the extent allowed by applicable third-party terms and conditions of use. You are aware that in case of alterations or manipulations of the Application, You will not have access to licensed Application.

WARRANTY

  1. Licensor warrants that the Application is free of spyware, trojan horses, viruses, or any other malware at the time of Your download. Licensor warrants that the Application works as described in the user documentation.
  2. No warranty is provided for the Application that is not executable on the device, that has been unauthorizedly modified, handled inappropriately or culpably, combined or installed with inappropriate hardware or software, used with inappropriate accessories, regardless if by Yourself or by third parties, or if there are any other reasons outside of Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders's sphere of influence that affect the executability of the Application.
  3. You are required to inspect the Application immediately after installing it and notify Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders about issues discovered without delay by e-mail provided in Product Claims. The defect report will be taken into consideration and further investigated if it has been mailed within a period of thirty (30) days after discovery.
  4. If we confirm that the Application is defective, Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders reserves a choice to remedy the situation either by means of solving the defect or substitute delivery.
  5. In the event of any failure of the Application to conform to any applicable warranty, You may notify the App-Store-Operator, and Your Application purchase price will be refunded to You. To the maximum extent permitted by applicable law, the App-Store-Operator will have no other warranty obligation whatsoever with respect to the App, and any other losses, claims, damages, liabilities, expenses and costs attributable to any negligence to adhere to any warranty.
  6. If the user is an entrepreneur, any claim based on faults expires after a statutory period of limitation amounting to twelve (12) months after the Application was made available to the user. The statutory periods of limitation given by law apply for users who are consumers.

PRODUCT CLAIMS

  1. product liability claims;
  2. any claim that the licensed Application fails to conform to any applicable legal or regulatory requirement; and
  3. claims arising under consumer protection, privacy, or similar legislation, including in connection with Your Licensed Application’s use of the HealthKit and HomeKit.

LEGAL COMPLIANCE

You represent and warrant that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and that You are not listed on any U.S. Government list of prohibited or restricted parties.

TERMINATION

The license is valid until terminated by Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders or by You. Your rights under this license will terminate automatically and without notice from Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders if You fail to adhere to any term(s) of this license. Upon License termination, You shall stop all use of the Application, and destroy all copies, full or partial, of the Application.

THIRD-PARTY TERMS OF AGREEMENTS AND BENEFICIARY

Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders represents and warrants that Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders will comply with applicable third-party terms of agreement when using licensed Application.

In Accordance with Section 9 of the "Instructions for Minimum Terms of Developer's End-User License Agreement," Apple and Apple's subsidiaries shall be third-party beneficiaries of this End User License Agreement and - upon Your acceptance of the terms and conditions of this license agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this End User License Agreement against You as a third-party beneficiary thereof.

INTELLECTUAL PROPERTY RIGHTS

Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders and the End-User acknowledge that, in the event of any third-party claim that the licensed Application or the End-User's possession and use of that licensed Application infringes on the third party's intellectual property rights, Chulalongkorn Centre of Excellence for Parkinson's Disease & Related Disorders, and not Apple, will be solely responsible for the investigation, defense, settlement and discharge or any such intellectual property infringement claims.

APPLICABLE LAW

This license agreement is governed by the laws of Thailand excluding its conflicts of law rules.

MISCELLANEOUS

  1. If any of the terms of this agreement should be or become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated in a way that will achieve the primary purpose.
  2. Collateral agreements, changes and amendments are only valid if laid down in writing. The preceding clause can only be waived in writing.

Collection of personal information

This privacy policy ("Policy") describes how the personally identifiable information ("Personal Information") you may provide in the "PDPlus" mobile application ("Mobile Application" or "Service") and any of its related products and services (collectively, "Services") is collected, protected and used. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is a legally binding agreement between you ("User", "you" or "your") and this Mobile Application developer ("Operator", "we", "us" or "our"). By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Automatic collection of information

Our top priority is customer data security and, as such, we exercise the no logs policy. We may process only minimal user data, only as much as it is absolutely necessary to maintain the Mobile Application and Services. Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage of the Mobile Application and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

Collection of personal information

You can access and use the Mobile Application and Services without telling us who you are or revealing any information by which someone could identify you as a specific, identifiable individual. If, however, you wish to use some of the features in the Mobile Application, you may be asked to provide certain Personal Information (for example, your name and e-mail address). We receive and store any information you knowingly provide to us when you create an account, or fill any online forms in the Mobile Application. When required, this information may include the following:

  • Personal details such as name, country of residence, etc.
  • Contact information such as email address, address, etc.
  • Account details such as user name, unique user ID, password, etc.
  • Geolocation data such as latitude and longitude.
  • Certain features on the mobile device such as contacts, calendar, gallery, etc.
  • Any other materials you willingly submit to us such as articles, images, feedback, etc.

Some of the information we collect is directly from you via the Mobile Application and Services. However, we may also collect Personal Information about you from other sources such as public databases or from King Chulalongkorn Memorial Hospital databases. Collection of medical information

We recognises that the information we collect is often of a highly sensitive nature and as an organisation we have adopted the privacy compliance standards relevant to King Chulalongkorn Memorial Hospital to ensure personal information is protected.

For administrative and billing purposes and to ensure quality and continuity of patient care a patient’s health information is shared between the medical practitioners of King Chulalongkorn Memorial Hospital.

Collected personal information will include patient’s

  • Names, addresses and contact details
  • Thai id number for identification purposes
  • Healthcare identifyers
  • Medical information including medical history, medications, allergies, adverse events, immunisations, social history, family history and risk factors.

A patient’s personal information may be held at the practice in various forms

  • As paper records
  • As electronic records
  • As visuals ie xrays, ct scans, videos & photos
  • As audio recordings

The practice’s procedures for collecting personal information is set out below:

  • Practice staff collect patient’s personal and demographic information via registration when patients present to the clinic for the first time. Patients are encouraged to pay attention to the collection statement that they complete as a new patient.
  • During the course of providing medical services the practice’s healthcare practitioners will consequently collect further personal information.
  • Personal information may also be collected from the patient’s guardian or responsible person (where practicable and necessary) or from other involved healthcare specialists.

The practice holds all personal information securely, whether in electronic format, in protected information systems or in hard copy in a secured environment.

Personal information collected by Excellence for Parkinson's Disease & Related Disorders may be used or disclosed in the following instances:

  • For medical defence purposes;
  • As required by law in instances of mandatory reporting of communicable diseases;
  • Necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety, or it is impracticable to obtain patient’s consent
  • To assist in locating a missing person For the purpose the patient was advised during consult with the treating Doctor;
  • As required during the normal operation of services provided. i.e. for referral to a medical specialist or other health service provider;
  • For the purpose of a confidential dispute resolution process
  • Some disclosure may occur to third parties engaged by or for the practice for the Practice for business purposes such as accreditation or for the provision of information technology. These third parties are required to comply with this policy.

The practice will not disclose personal information to any third party other than in the course of providing medical services, without full disclosure to the patient or the recipient, the reason for the information transfer and full consent from the patient.

The Practice will not disclose personal information to anyone outside country without need and without patient consent.

The Practice will not use any personal information in relation to direct marketing to a patient without that patient’s express consent.

The practice evaluates all unsolicited information it receives to decide if it should be kept, acted upon or destroyed.

We will employ all reasonable endeavours to ensure that a patient’s personal information is not disclosed without their prior consent.

Use and processing of collected information

In order to make the Mobile Application and Services available to you, or to meet a legal obligation, we may need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested products or services. Any of the information we collect from you may be used for the following purposes:

  • Create and manage user accounts
  • Send administrative information
  • Respond to inquiries and offer support
  • Request user feedback
  • Improve user experience
  • Enforce terms and conditions and policies
  • Protect from abuse and malicious users
  • Respond to legal requests and prevent harm
  • Run and operate the Mobile Application and Services

Processing your Personal Information depends on how you interact with the Mobile Application and Services, where you are located in the world and if one of the following applies:

  • You have given your consent for one or more specific purposes; this, however, does not apply, whenever the processing of Personal Information is subject to European data protection law;
  • Provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof;

  • Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us;

Managing information

You are able to delete certain Personal Information we have about you. The Personal Information you can delete may change as the Mobile Application and Services change. When you delete Personal Information, however, we may maintain a copy of the unrevised Personal Information in our records for the duration necessary to comply with our obligations to our affiliates and partners, and for the purposes described below. If you would like to delete your Personal Information or permanently delete your account, you can do so by contacting us.

Disclosure of information

Depending on the requested Services or as necessary to complete any transaction or provide any service you have requested, we may share your information with your consent with our trusted third parties that work with us, any other affiliates and subsidiaries we rely upon to assist in the operation of the Mobile Application and Services available to you. We do not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. We may share your Personal Information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to Personal Information. These third parties are given Personal Information they need only in order to perform their designated functions, and we do not authorize them to use or disclose Personal Information for their own marketing or other purposes.

We will disclose any Personal Information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

Retention of information

We will retain and use your Personal Information for the period necessary to comply with our legal obligations, resolve disputes, and enforce our agreements unless a longer retention period is required or permitted by law. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.

The rights of users

You may exercise certain rights regarding your information processed by us. In particular, you have the right to do the following: (i) you have the right to withdraw consent where you have previously given your consent to the processing of your information; (ii) you have the right to object to the processing of your information if the processing is carried out on a legal basis other than consent; (iii) you have the right to learn if information is being processed by us, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information undergoing processing; (iv) you have the right to verify the accuracy of your information and ask for it to be updated or corrected; (v) you have the right, under certain circumstances, to restrict the processing of your information, in which case, we will not process your information for any purpose other than storing it; (vi) you have the right, under certain circumstances, to obtain the erasure of your Personal Information from us; (vii) you have the right to receive your information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that your information is processed by automated means and that the processing is based on your consent, on a contract which you are part of or on pre-contractual obligations thereof.

Privacy of children

We do not knowingly collect any Personal Information from children under the age of 18. If you are under the age of 18, please do not submit any Personal Information through the Mobile Application and Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Mobile Application and Services without their permission. If you have reason to believe that a child under the age of 18 has provided Personal Information to us through the Mobile Application and Services, please contact us. You must also be old enough to consent to the processing of your Personal Information in your country (in some countries we may allow your parent or guardian to do so on your behalf).

The Mobile Application and Services contain links to other resources that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other resources or third parties. We encourage you to be aware when you leave the Mobile Application and Services and to read the privacy statements of each and every resource that may collect Personal Information.

Information security

We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and the Mobile Application and Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.

Data breach

In the event we become aware that the security of the Mobile Application and Services has been compromised or users Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will send you an email, get in touch with you over the phone.

Changes and amendments

We reserve the right to modify this Policy or its terms relating to the Mobile Application and Services from time to time in our discretion and will notify you of any material changes to the way in which we treat Personal Information. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Mobile Application and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes. However, we will not, without your consent, use your Personal Information in a manner materially different than what was stated at the time your Personal Information was collected.
